1. About these Terms
These Terms form an agreement between David Currie, a sole trader trading as David Currie Education under the Oracy Spark brand (“Oracy Spark”, “we”, “us” or “our”), and the person, school or organisation purchasing or using a membership or subscription (“you” or “your”).
Oracy Spark is an online educational service providing speaking, listening and oracy prompts and related resources for use in educational settings and at home.
By purchasing a membership or subscription, accepting these Terms at checkout, creating an account or using the paid service, you agree to these Terms. Anyone purchasing on behalf of a school or organisation confirms that they are authorised to do so.
2. Plans and access
The content and age ranges included in your plan are described on the pricing page and at checkout. Plans may cover an individual, a specified school phase or a wider infant, junior or whole-school setting.
An individual membership is for one named person’s own educational use, within the year-group phase included in their plan. Individual memberships are available to teachers, tutors, home educators and families.
An individual membership is attached to the named member rather than to a particular class. A teacher, tutor or home educator may use the included resources with the children they personally teach or educate, subject to these Terms. A family purchasing an individual membership may use the resources for educational use within their own family or household.
An individual membership does not give other adults access to the service or resources under that membership and must not be shared between teachers, tutors, families or other individuals.
A school subscription covers one named school and the age ranges included in the plan purchased. Authorised staff at that school may use the included content for the school’s internal teaching and learning. The school is responsible for use under its subscription and for ensuring its staff comply with these Terms and the Acceptable Use Policy.
A multi-academy trust, federation, local authority, tutoring company or other group needs a separate subscription for each school or site using the service, unless we agree a wider licence in writing. A school subscription cannot be shared across separate schools simply because they belong to the same organisation.
Eligible schools may also request a 21-day free trial before purchasing a school subscription. Trial access is limited to the school phases selected at registration and includes access to the Spark Generator and relevant PowerPoint archives (the Sparkive). During the trial, schools receive the relevant weekly PowerPoint resources by email, as paying school subscribers do. Weekly email delivery ends when trial access expires unless the school purchases a subscription.
Trial users must comply with these Terms, including the permitted-use and content-sharing restrictions.
Subject to payment and compliance with these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the content included in your plan during its paid membership or subscription period. Ownership of Oracy Spark and its content does not transfer to you.
3. Accounts and security
You must provide accurate account and billing information and keep login details secure.
An individual member must not share their login with another person.
A school may request individual accounts for authorised staff at the licensed school, including during its free trial. Each staff member must keep their own login details secure and must not share them. Accounts and access must not be provided to pupils, parents, another school or external third parties. All staff accounts at one school are covered by the same school trial or subscription, including its expiry date.
Tell us promptly at hello\@oracyspark.com if you suspect unauthorised access. We may ask you to take reasonable security steps, including resetting a password.
4. Permitted educational use
You may display content included in your plan to the children or pupils covered by the permitted use of that plan and use it in lessons, assemblies, home education and other appropriate educational activities.
Teachers, tutors and home educators with an individual membership may use the resources with the children they personally teach or educate. Family members may use them for educational activities within their own family or household.
Where downloadable resources, including PowerPoint presentations, are included in a plan, they may be downloaded and retained by the named individual or licensed school for their own permitted educational use. They must not be forwarded, distributed or shared with people, schools or organisations who are not covered by that plan.
You may make limited copies or screenshots where reasonably necessary for permitted educational use, provided any Oracy Spark attribution is retained.
Free samples and demo materials may be used in accordance with any instructions shown alongside them. Access to a free resource or demo does not grant access to paid content.
5. Prohibited use
You and anyone using your access must not:
- share login details or paid content outside the people covered by your plan;
- forward or distribute downloadable paid resources to people, schools or organisations not covered by your plan;
- resell, sublicense, rent, distribute or commercially exploit the service or its content;
- publish substantial paid content on websites, social media, video platforms, shared resource banks or open file-sharing services;
- systematically download, scrape, record, copy or archive the service other than downloading resources expressly provided for use under your plan;
- use automated means to access the service without our permission;
- remove copyright, trade mark or attribution notices;
- reproduce substantial protected content to create a competing resource or service;
- bypass access controls, probe security, introduce harmful code or disrupt the service; or
- use the service unlawfully or in a way that infringes another person’s rights.
Nothing in these Terms restricts a use that the law expressly permits and that cannot lawfully be excluded.
6. Educational responsibilities
Oracy Spark is an educational resource. The teacher, tutor, home educator, family or school using it remains responsible for deciding whether a prompt or resource is suitable for the children using it, supervising its use, making appropriate adaptations and following any safeguarding, equality, SEND and data-protection responsibilities that apply to them.
Schools, teachers and tutors remain responsible for following their own applicable safeguarding and organisational procedures.
Do not enter or upload pupil or child names, contact details, responses, safeguarding information, special-category information or other personal data into Oracy Spark, including any prompt-generation feature.
Where a feature generates suggested content, check it for accuracy, suitability and accessibility before using it with children. Generated suggestions may need editing and may not be unique.
7. Prices and payment
The price, content covered, billing period and renewal terms of each plan are shown at checkout.
Payments are made in pounds sterling through the payment methods offered at checkout, currently provided through Stripe. The checkout will show any applicable taxes and discounts before you pay.
Access normally begins after successful payment. If a payment fails or is reversed, we may contact you, retry it where the payment arrangement permits, or suspend access until payment is received.
Promotional and introductory prices apply only under the conditions stated with the relevant offer.
Individual memberships are available at £3.99 per month or £29 per year, subject to the plan details shown at checkout.
Under the Founding Schools Offer, the first 50 qualifying paying schools may purchase an infant or junior school membership for £59 per year, or a whole-school membership for £99 per year. These founding prices are guaranteed for the first two annual subscription payments, provided the subscription remains active.
From the third annual subscription payment, the standard annual price applies (£129 for infant and junior schools, or £199 for whole schools), unless a different price is agreed or notified before renewal.
We will notify schools in advance of any renewal at a higher price, giving them the opportunity to cancel before payment is taken.
8. Automatic renewal and cancellation
A paid membership or subscription renews automatically at the end of each billing period unless cancelled before its renewal date. The renewal period and price are shown at checkout.
We will send a renewal reminder to the account email address before an annual renewal, stating the date and price.
You can cancel through any cancellation option we make available for your membership or subscription or by emailing hello@oracyspark.com before the renewal date. Include your account email and, for a school subscription, the school name. We will acknowledge cancellations sent by email.
Cancellation normally takes effect at the end of the current paid period. Access continues until then, and no further renewal payment will be taken.
If you have not received an acknowledgement of an emailed cancellation within five working days, please contact us again.
Any statutory cancellation rights that apply to an individual purchasing as a consumer are unaffected by this section. Details of refunds are in our Refund Policy.
8A. Free school trials
Oracy Spark offers eligible schools a 21-day free trial without requiring payment card details.
The trial begins when we activate the school's membership access and notify the school, rather than when the registration form is submitted.
No payment is collected during the trial, and no subscription or automatic charge is created when it ends.
Schools wishing to continue using Oracy Spark must purchase a paid school membership. If no qualifying purchase is made, trial access will expire after 21 days.
One trial period applies to the school and all participating staff accounts, regardless of when individual staff members are invited. Only one free trial is normally available per school. We reserve the right to decline duplicate or inappropriate trial requests.
Free trials are available exclusively to schools and do not apply to individual memberships.
9. Individual teacher refund when their school joins
If a teacher buys an individual membership and their school buys an infant, junior or whole-school subscription within 30 days of the teacher’s purchase, the teacher may request a refund of their individual membership fees, up to £29.
This offer applies specifically to an individual teacher whose school subsequently purchases a qualifying Oracy Spark school subscription. We may ask for information to verify that the individual works at the subscribing school.
An approved refund is made to the individual’s original payment method. We will cancel the individual membership so that it does not renew separately. The school’s subscription is a separate purchase.

9A. Individual membership money-back guarantee
Individual members purchasing their first Oracy Spark membership are covered by our 21-day money-back guarantee.
If you are not satisfied with your membership, you may request a full refund of your initial payment within 21 calendar days of purchase, without needing to provide a reason.
This guarantee applies to both monthly and annual individual memberships. It applies only to the initial purchase and not to subsequent renewals or repeat purchases.
To request a refund, email hello\@oracyspark.com within 21 days of purchase.
Following a refund, the subscription will be cancelled and membership access will end.
This voluntary guarantee does not affect any statutory consumer cancellation or refund rights. Further details are available in our Refund Policy.
10. Changing a school plan
A school wishing to move to a broader plan should contact us before purchasing it so we can arrange the change and avoid overlapping subscriptions.
The treatment of any unused paid period is set out in our Refund Policy. Purchasing a second plan through a separate payment link does not automatically cancel the existing plan or apply a credit.
11. Price changes
We may change plan prices.
An increase affecting an existing paid membership or subscription will apply no earlier than its next renewal. We will notify the account holder before that renewal so they can decide whether to continue or cancel.
12. Availability and service changes
We aim to provide reliable access but cannot guarantee that the service will always be uninterrupted or error-free. Access may occasionally be affected by maintenance, security work, updates, supplier outages or circumstances beyond our reasonable control.
We may correct, replace, update, add or remove individual prompts, resources and features. We will not deliberately remove the essential substance of a paid plan during its term without a reasonable replacement or appropriate remedy.
12A. Resource delivery and school holidays
Where a plan includes regularly delivered resources, we aim to make resources for the following teaching week available by the end of the previous week.
Regular weekly delivery may pause during the main Christmas, Easter and summer school holiday periods. Resources for the start of a new term will normally be made available in advance of the relevant teaching week.
We do not normally pause delivery for individual school or local-authority half-term dates. As school calendars vary, resources may therefore be delivered during a period when your school or setting is closed. They can be retained and used when appropriate for your setting.
Delivery schedules may occasionally vary, including to accommodate school-calendar differences, public holidays or service updates.
13. Intellectual property
Oracy Spark’s original prompts, PowerPoint presentations, downloadable resources, generated-resource templates, text, graphics, branding, arrangement, design and software belong to us or our licensors and are protected by intellectual-property law.
The licence in section 2 is the only right granted to you.
14. Suspension and termination
If we reasonably suspect a breach of these Terms, we may investigate and ask you to correct it. For a minor or inadvertent breach, we will normally provide a reasonable opportunity to do so.
We may suspend access immediately where reasonably necessary to protect security, prevent significant unauthorised sharing, comply with the law or protect the service and its users.
We may terminate access for a serious breach, fraud, deliberate misuse, non-payment or a repeated breach that is not remedied after notice.
Any refund following suspension or termination is governed by the Refund Policy and applicable law.
15. Refunds and legal rights
Our Refund Policy forms part of these Terms.
Nothing in these Terms or that policy removes a right or remedy that cannot legally be excluded, including applicable consumer rights.
16. Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
Subject to those protections and to any rights that cannot legally be excluded, we are not responsible for educational outcomes, decisions made when using the resources, or losses arising from a failure to check suggested content before use.
We are not responsible for problems caused by your internet connection, devices or third-party systems.
For school and organisational subscriptions, and subject to the first paragraph of this section, our total liability arising from a subscription in any subscription year is limited to the amount paid for that subscription year, to the extent permitted by law.
17. Privacy
We process personal information as described in our Privacy Policy.
Schools and organisations must ensure they are entitled to provide the contact and account information they submit to us. Where a school provides colleagues’ email addresses for trial invitations, we may use those addresses to send account invitations and service-related information about the trial. Promotional marketing is handled separately in accordance with our Privacy Policy and applicable law.
18. Changes to these Terms
We may make changes to clarify these Terms, reflect changes in law, improve security or describe changes to the service.
We will notify account holders of material changes. A material change that disadvantages an existing paid member or subscriber will normally take effect at their next renewal unless an earlier change is required by law or necessary to protect the service or its users.
19. General
If a provision is found unenforceable, the remaining provisions continue. A delay in enforcing a right does not waive it.
You may not transfer your paid access to another person, school or organisation without our written agreement.
These Terms, the Acceptable Use Policy, Refund Policy and any terms expressly stated at checkout form the agreement concerning your membership or subscription, except for anything separately agreed in writing.
20. Governing law and contact
These Terms are governed by the law of England and Wales.
For school and organisational subscriptions, the courts of England and Wales have jurisdiction over disputes. An individual purchasing as a consumer retains any right to bring a claim in another court where applicable law permits.
