Acceptable Use Policy

This policy forms part of the Oracy Spark Terms and Conditions and applies to individual members, schools and organisations, including those accessing Oracy Spark through a free school trial, and everyone using the service under their membership, subscription or trial access.

1. Account holders must

Limit access to the people covered by their plan: the named individual for an individual membership, or authorised staff at the named school for a school subscription or trial.
Ensure each authorised staff member uses their own account and keeps their login details secure.
Promptly report suspected unauthorised access.
Use the service for lawful educational activity within the scope of their plan.
Apply appropriate judgement, safeguarding procedures and suitable adaptations before using content with children or pupils.
Respect copyright, privacy and the rights of children, pupils, staff and others.
Cooperate with reasonable steps to investigate and remedy suspected misuse.

2. Users must not

Share their individual login details with anyone else, including other staff members at the same school.
Give access to another individual, family, school, organisation or other third party who is not covered by the relevant plan.
Forward or distribute paid or trial downloadable resources, including PowerPoint presentations, to people, schools or organisations not covered by the relevant plan.
Upload, republish, broadcast, resell or otherwise distribute substantial Oracy Spark content, including through public websites, social media, shared resource banks or file-sharing services.
Systematically copy, record, scrape or archive the service, other than downloading resources expressly provided for use under their plan.
Reproduce substantial protected content to develop or populate another product or resource.
Remove ownership or attribution notices.
Bypass access controls, test vulnerabilities without permission, introduce harmful code or interfere with the service.
Use the service for unlawful, discriminatory, abusive, misleading or rights-infringing activity.
Enter names, responses, safeguarding information, special-category information or other personal data relating to children or pupils into the website or Spark Generator.

3. Educational use and the Spark Generator

Individual members may use content included in their plan for their own permitted educational use. Teachers, tutors and home educators may use it with the children they personally teach or educate. Families may use it for educational activities within their own family or household.

Authorised staff at a licensed school may use content included in the school's subscription for that school's internal teaching and learning, including appropriate lessons, assemblies and other educational activities.

Downloadable resources, including PowerPoint presentations, may be downloaded and retained by the named individual or licensed school for their own permitted educational use, as described in the Terms and Conditions.

Spark Generator results must be checked for accuracy, suitability and accessibility before being used with children or pupils. Do not enter confidential information or information that identifies any person into the generator.

Do not publicly post screenshots, recordings or substantial extracts of paid resources without our written permission. If Oracy Spark material appears incidentally in a photo or short clip of ordinary educational activity, it must not be used as a way to distribute the resource.

4. Free school trials

Eligible schools may receive a 21-day free trial of Oracy Spark.

During the trial, authorised staff may access and use resources included in the school's selected trial package for internal teaching and learning.

Trial access includes the relevant weekly PowerPoint resources, the Spark Generator and the Sparkive, subject to the access permissions provided.

Multiple authorised staff members from the same school may participate in the trial using their own individual accounts. All staff at that school share the same 21-day trial period, beginning when Oracy Spark activates the school's trial and notifies the school.

The same restrictions on sharing, distribution, copyright and permitted educational use apply to trial users as to paying subscribers.

Trial access ends after 21 days unless the school purchases a paid membership or Oracy Spark expressly agrees to extend access.

Downloaded resources must not be used or distributed after the trial ends unless the school subsequently purchases a membership or receives written permission from Oracy Spark.

If the school purchases a qualifying membership, authorised staff may continue using resources covered by that membership, subject to the Terms and Conditions.

5. Enforcement

We may ask for an explanation or corrective action, require a password reset, restrict particular activity or suspend access while investigating a credible concern.

We will normally give a minor or accidental breach a reasonable chance to be corrected. Serious, deliberate or repeated misuse may lead to termination, with any refund determined under the Refund Policy and applicable law.

6. Reporting concerns

Report security issues, unauthorised sharing or other misuse to hello@oracyspark.com.

Please give us a reasonable opportunity to investigate a suspected vulnerability before disclosing its details publicly.
